Truckers Sue State of Oregon Over Unconstitutional, Excessive Taxation

Three trucking companies have joined the Oregon Trucking Association in suing the state for imposing $528,000 daily in excess state weight-mile taxes on heavy trucks, amounting to nearly $1 million in overpayment collectively. The lawsuit alleges that this overpayment violates the state's constitution, which mandates fair and proportionate taxes for highway usage. Trucking companies argue that despite paying a disproportionate share of taxes, promised road improvements have not materialized, leading to unsafe road conditions. The lawsuit seeks an injunction to stop the unconstitutional taxes and calls for an immediate review and adjustment of revenue sources. ODOT estimates heavy vehicles will overpay by approximately $193 million per year from 2023 to 2025, prompting accusations of government failure to rectify the situation.
